EU-UK dispute affects freedom of movement

Researchers have argued that tensions between Britain and the European Union (EU) are beginning to have a negative impact on EU citizens’ freedom of movement.

Researchers from the Universities of Edinburgh and Glasgow said that they found the UK Border Agency (UKBA) had rejected a high number of applications, particularly those made by family members of EU citizens.

The report also claims that in some cases, the UKBA and the Home Office significantly differ to the European system.

The statement insists that a citizen “champion” should be introduced to guide and support the achievement of EU law in relation to freedom of movement.

Professor Jo Shaw, from the University of Edinburgh’s School of Law and lead author of the report said, “We started our work with a broad sense that something might be amiss with the application of EU law in the UK. Our detailed work has highlighted the area where there are tensions, for example, regarding family members.”

The report then accuses the UKBA and courts and tribunals in Britain of not fully recognizing EU law.

It says the tension exists because EU free movement law is rights-based and UK immigration law is permissions-based.
