President Rouhani Gives 60 Days to G4+1 to Provide Iran with Nuclear Deal Merits

Iranian President Hassan Rouhani warned the Group 4+1 (China, Russia, Britain and France Plus Germany) that they have two months to fully implement the 2015 nuclear deal after Tehran modified two of its undertakings under the JCPOA in return for the US abrogation of the deal and other signatories' inability to provide Tehran with any economic merits under the agreement.

The European signatories to the Joint Comprehensive Plan of Action (JCPOA) were doing well in lip service, but practically they were unable to implement what they vowed, President Rouhani said, addressing a cabinet meeting in Tehran on Wednesday on the first anniversary of the US withdrawal from the deal.

After the US withdrawal from the deal, also known as the JCPOA on May 8, 2018, the European signatories pledged to take actions to neutralize the restrictions caused by the unilateral withdrawal.

“Based on a decision made by Iran’s Supreme National Security Council, I have sent messages to the five countries remaining under the nuclear deal, reminding them that we have already given them a year(long chance) as they requested us,” Rouhani said.

“It was a strategic patience on our part,” he said. Rouhani clarified that Iran “is not leaving the nuclear deal today”, but said if the remaining signatories fail to provide Iran with the stated merits in two months, Tehran would stop complying with other nuclear deal undertakings in consequent phases.

He said the costs of the nuclear deal should be paid by all sides and not just Iran, stressing that the deal was struck on the basis of a win-win game. Otherwise, it would be a lose-lose situation for everyone.

Hence, Rouhani wished to see the five remaining parties to the deal to show action to avoid such a situation.

“It is not the end of JCPOA, rather it is a new phase of the deal in the context and in line with the wording of the JCPOA,” Rouhani said.

“Articles 26 and 36 entitle Iran to raise complaint about breach of the international deal in the joint commission,” he noted.

The Article 36, under the Dispute Resolution Mechanism, says, “If Iran believes that any or all of the E3/EU+3 were not meeting their commitments under this JCPOA, Iran could refer the issue to the Joint Commission for resolution.”

The Article 26 stipulates, “The EU will refrain from re-introducing or re-imposing the sanctions that it has terminated implementing under this JCPOA, without prejudice to the dispute resolution process provided for under this JCPOA.”

“In the message, we have stated to the remaining signatories that Iran has changed its mind on two of the measures it has taken under the deal,” and will change course accordingly, Rouhani said, as Iran’s Supreme National Security Council (SNSC) announced that Tehran will no more abide by its JCPOA restrictions on keeping enriched uranium and heavy water reserves.

After the two-month-long period, Rouhani added, if the five countries come to the negotiating table to come to terms with Iran’s interests particularly with regard to oil and banking, we would return to the previous position and resume those two undertakings.

Otherwise, restrictions on the 3.6 percent level of enrichment and the heavy water reactor restrictions would no more be observed, he said.

Rouhani stressed that the nuclear deal was to the interest of the world and the region, but the enemies of Iran pressed US to withdraw from the Joint Comprehensive Plan of Action.

“The JCPOA has a national strategic foundation, it was not an individual or partisan or governmental issue,” he said.

“Rather, it was a national decision which was made by the entire governing system,” Rouhani said.

The enemies, including the American hardliners, Zionists, and the reactionaries in the region, were opposed to the international deal since the very moment it was reached, he added.

“It was to the interest of the region and the world, but not the enemies of Iran, therefore they spared no effort since 2015 to undermine the elegant structure of the international deal,” President Rouhani said.

He added that the people in the region, the Europeans and even the US allies and the international companies are suffering from the US policies, creating restrictions for the European companies doing business with Iran.

“But the Zionism and the reactionaries, AIPAC (American Israel Public Affairs Committee) pressured the US to withdraw from the deal,” Rouhani underscored.

“We have never been the first to violate the commitments or to wage wars, but at the same time we have never surrendered to bullying and will not do so, and we will certainly give appropriate response to any kind aggression,” he said.

President Rouhani also stressed Iran’s role in fighting terrorism, establishment of regional security, preventing the flow of refugees to the Europe and confronting illegal drugs traffickers, saying that these moves require Iran to spend billions of dollars.

If the nuclear deal is good for the regional peace, therefore, everybody should pay for it, he said.

Iran’s SNSC announced in a statement on Wednesday that the country had modified two of its undertakings under the Joint Comprehensive Plan of Action in return for the US abrogation of the deal and other signatories inability to make up for the losses under the agreement, warning that modifications would continue if the world powers fail to take action in line with their promises.

“The Islamic Republic of Iran declares that at the current stage, it does not any more see itself committed to respecting the limitations on keeping enriched uranium and heavy water reserves,” the statement said.

The statement gave the Group 4+1 “60 days to put into action their nuclear deal undertakings, specially in the banking and oil sectors, warning that “in case these countries fail to meet Iran’s demands, the Islamic Republic of Iran will cease implementation of restrictions on uranium enrichment levels and measures related to the modernization of Arak Heavy Water Reactor as well”.

“Once our demands are met, we will resume implementation of the ceased undertakings. Otherwise, the Islamic Republic of Iran will stop compliance with its other undertakings in consequent phases,” the SNSC warned.

It underlined Iran’s readiness to continue its consultations with the countries which have remained in the nuclear deal at all levels “but will show a firm and rapid reaction to any irresponsible measure, including referring the issue to the UN Security Council or imposition of more sanctions”.

“The Islamic Republic of Iran’s president has in his letter to the leaders of the nuclear deal member states clearly reminded them of the Islamic Republic of Iran’s type of reaction,” the statement added.

It reminded the G4+1 of Iran’s good will during the nuclear talks, implementation of the nuclear deal and  giving sufficient time to the other signatories to implement the deal, saying that it is now their turn to prove their good will and adopt serious and practical measures to protect the nuclear deal.

“The door of diplomacy will not remain open for a long time and the US and other members remaining under the nuclear deal are fully responsible for failure of the nuclear deal and any possible consequences,” the statement said.

It underlined that the decision was made in line with defending the Iranian nation’s security and national interests and materialization of Iran’s rights stated in the paragraphs 26 and 36 of the nuclear deal.

President Rouhani in a letter on Wednesday informed the Group 4+1 on stopping implementation of a number of Tehran’s undertakings stated in the 2015 nuclear deal.

Iranian Deputy Foreign Minister for Political Affairs Seyed Abbas Araqchi submitted the letter to the ambassadors of the G4+1 to Tehran after they were called to the foreign ministry on Wednesday morning.
The letter contains decisions by the SNSC to “halt implementation of a number of the Islamic Republic of Iran’s undertakings under the nuclear deal”.

Also, another letter was sent by Iranian Foreign Minister Mohammad Javad Zarif to EU Foreign Policy Chief Federica Mogherini on Wednesday morning to inform her of details of Iran’s measures.

Washington withdrew from the internationally-endorsed 2015 nuclear deal with Iran, reimposed the toughest-ever sanctions against the country and started a plan to zero down Tehran’s oil sales.

Under the nuclear agreement reached between Iran and six world powers in July 2015, Tehran undertook to put limits on its nuclear program in exchange for the removal of nuclear-related sanctions.

Yet, Iran continued compliance with deal, stressing that the remaining signatories to the agreement had to work to offset the negative impacts of the US pullout for Iran if they want Tehran to remain in compliance.

Iranian officials had earlier warned that the European Union’s failure in providing the needed ground for Tehran to enjoy the economic benefits of the nuclear deal would exhaust the country’s patience.

Head of the Atomic Energy Organization of Iran (AEOI) Ali Akbar Salehi warned in December that his country enjoys the capability to restore 20-percent uranium enrichment if the parties still remaining under the 2015 nuclear deal could not remain committed to their undertakings.

Salehi said that under the 2015 nuclear deal, Iran accepted to put confidence-building curbs on its nuclear program, but they do not obstruct the “peaceful activities of Iran’s nuclear industry”.

“Enrichment is currently underway, but we would put aside the 300kg limit (set by the nuclear agreement) whenever we wish, and would do the enrichment at any volume and level,” he said in an interview with state TV on the sidelines of a visit to the Fordo nuclear facility.

“We currently have 1,044 centrifuges in Fordo, and if the establishment wants, we will restart 20-percent uranium enrichment in Fordo,” he noted.

He expressed hope that the remaining parties to the nuclear agreement would deliver on their promise and implement their obligations in order to fill the gap created by the US after its unilateral withdrawal from deal, officially known as the JCPOA.

Otherwise, he said, Iran would have to reduce its JCPOA commitments.

“I would like to warn that this is not a bluff; I have kept my word whenever I’ve said something. Now I’m emphasizing once again that if the establishment wants, we can easily return to the 20-percent enrichment, and meet the country’s needs at any level and volume,” he noted.

Europeans’ honesty in dealing with the Iran nuclear deal has always been seriously doubted by Iranian masses that were discontent with talks with European counterparts.

The US state department announced on Friday that it had not extended two waivers, one that allowed Iran to store excess heavy water produced in the uranium enrichment process in Oman, and one that allowed Iran to swap enriched uranium for raw yellowcake with Russia.

Until now, Iran was allowed to ship low-enriched uranium produced at Natanz to Russia before it hit the 300-kg limit and the US measure leaves no way for Tehran other than exceeding the ceiling for storing the enriched uranium in violation of the 2015 nuclear deal.

Also, the United States would no longer waive sanctions that allowed Iran to ship heavy water produced at its Arak facility beyond a 300-ton limit set in the 2015 nuclear deal to Oman for storage which again forces Tehran to store it inside country in violation of the nuclear deal.

In return, Iranian Parliament Speaker Ali Larijani said on Saturday said that Iran would continue uranium enrichment after Washington defied to extend waivers on swapping enriched uranium for raw yellowcake with Russia, a mechanism stated in the nuclear deal to ensure a ceiling of a 300kg enriched uranium stockpile in Iran.

“The Americans have stated in the past few days that Iran is not entitled to produce heavy water, while we have not violated the (2015) nuclear deal and the laws and if you (the Americans) do not buy it, it is not important and we continue what we are doing,” Larijani said in Tehran, addressing a group of Iranian school teachers on the occasion of Teachers Day in Iran.

Reminding that Iran had been importing yellowcake to process it into enriched uranium and sold the final product to Russia to keep its enriched uranium stockpile under 300kg, as enshrined in the Joint Comprehensive Plan of Action, he noted the US’ recent decision to end waivers on this JCPOA undertaking, and said the Americans had also voiced opposition to Iran’s enrichment of uranium.

Larijani addressed the US and other western states, saying that Iran did not care if its enriched uranium was purchased or not as “Iran will continue enrichment”, implying that Tehran would be forced to go above the ceiling if the stated JCPOA-related mechanism fails.

Larijani’s remarks meant that Iran would not go for the second option which entails stopping heavy water or uranium production to avoid exceeding the stated ceilings if Oman and Russia choose to comply with the US sanctions in violation of the JCPOA.

Araqchi said last week that the nuclear deal between Tehran and the world powers might die any moment now, warning that the US efforts to ruin an international treaty had damaged Tehran’s trust in any international agreement.

Speaking during a visit to Turkey for Iran-Turkey political consultations, Araqchi said that Tehran’s patience with the US was wearing thin.

“Iran has given enough chances to diplomacy, but enough is enough,” Araqchi who was the second lead negotiator during the nuclear talks with the world powers said, and warned, “Unfortunately, the JCPOA has come very very close to its end.”

He said his country would definitely take action against the US campaign of intensifying pressures on Iran that also included efforts to zero down the country’s crude sales.

He said the nuclear deal of the 2015, also known as the Joint Comprehensive Plan of Action (JCPOA), was a security deal involving the entire world, and lamented that “the US financial system has cast a shadow on everyone”.

The diplomat reiterated that the agreement was clinched between Iran and 5+1 Group of countries (Russia, China, France, the US, the UK, and Germany), but in principal it was an accord belonging to the global community.

Reiterating that the JCPOA was the sole diplomatic success of the region, Araqchi said that US exit from the deal reduced Iran’s trust in the international deals, as the US was seeking to destroy the only regional diplomatic achievement.
